Government Senior Training Officer faces misconduct charges over training package contracts

A Senior Training Officer of the Civil Service Training and Development Institute (CSTDI), who was alleged to have wilfully concealed her marital relationship with the contractor when awarding him contracts for the production of various CSTDI training materials, was charged by the ICAC with misconduct in public office.

It was alleged that the husband of Chung Sim-ying, Tracy, was the proprietor of a production house awarded contracts worth $133,400 in total as a result of Chung's recommendation.

Chung was said to have failed to declare her conflict of interest.

Chung, 31, is currently on ICAC bail. She will appear at Eastern Court tomorrow (Friday) at 9:30 am to face six counts of misconduct in public office under the Common Law, and three counts of using false documents to deceive her principal under Section 9(3) of the Prevention of Bribery Ordinance.

The charges alleged Chung of having misconducted herself in discharging her duties between January and September 1999.

Chung was said to have wilfully concealed the fact that she was married to the proprietor of TOD Promotions (TOD) when recommending TOD for contracts in relation to the design, printing and production service of various CSTDI publications and training packages.

Such materials included two booklets on “The Defence and Security Systems of the PRC” and “The Education System in the PRC”, and their versions in videotape and VCD, a booklet “30 FAQ on the Basic Law”, a poster and a leaflet on “Promoting the Basic Law – Lyrics Competition”.

She was also alleged to have falsely declared on her minutes to CSTDI’s Chief Training Officer that quotations given by TOD in relation to various jobs were the lowest amongst the tenderers on three occasions between January and September 1999, with intent to mislead her principal.
