Three FEHD officers charged for alleged 'scapegoat' plot

Three Assistant Hawker Control Officers (AHCOs) of the Food and Environmental Hygiene Department (FEHD) and four civilians were today (Wednesday) charged by the ICAC for allegedly arranging for a "scapegoat" to face prosecution for obstruction offences in Marble Road, North Point.

Leung Yuk-hung, 33, Lee Chi-yeung, 53, Yim Fat-on, 39, all AHCOs; Wong Sang, 66, Huen Fong-kit, 42, Ho Shit, 67, all hawkers; and Lau Wai-lin, 38, unemployed, will appear at 9:30 am in Eastern Court tomorrow (Thursday) .

The three FEHD officers were each charged with one count of doing an act tending and intended to pervert the course of public justice.

It was alleged that the trio had arrested Lee Yee, a hawker, on three separate occasions, for an offence of obstruction of public place, knowing that Lee had not committed the offence.

The obstruction offences related to the placing of a metal handcart, two carton boxes and a cloth cover in Marble Road.

The remaining four defendants faced a joint charge of conspiracy to pervert the course of public justice.

Wong, Huen, Ho and Lau were said to have conspired with other persons to falsely represent to hawker control officers of the then Urban Services department and Courts of Justice in Hong Kong that certain hawkers were the owners of hawker barrows which had obstructed public places.

The alleged offences took place between January 1, 1997 and January 31 this year.

The FEHD had rendered full assistance to the ICAC during its investigation into this case.

Meanwhile, the ICAC investigation into the alleged "scapegoat" plot has unearthed a separate case in connection with possession of ammunition and radio communication apparatus without a licence involving another AHCO.

Wong Fat-ng, 38, will also appear at 9:30 am in Eastern Court tomorrow to face two offences.

The charges alleged that on February 1 this year, Wong had in his possession 661 rounds of ammunition, 23 rounds of blank ammunition, an "ICOM" FM transceiver and antenna with a battery, and a "JDI" speaker/microphone, without licences.

The eight defendants in both cases have been released on ICAC bail, pending their court appearances tomorrow.
