Woman penalised for making false report to ICAC

A woman was today (Monday) sentenced to 100 hours of community service at Eastern Court for fabricating a corruption allegation against a supervisor of an electrical appliances company, who was a former lover of her boyfriend.

Kwok Ling-yan, 27, earlier pleaded guilty to an offence under Section 13B(a) of the Independent Commission Against Corruption Ordinance, which carries a maximum penalty of an one-year jail term and a $20,000 fine.

Magistrate Mr Henry Mierczak said it was a serious offence to make false reports to the ICAC and abuse the Commission's resources.

The ICAC had spent about 17 man-hour on the concocted complaint.

The court heard that Kwok had knowingly made a false report to the ICAC on July 10 last year, alleging that Chan Sui-ming had attempted to use a false attendance record to claim wages from Chiap Hua International Limited (Chiap Hua) on behalf of Kwok.

Chan is a sales promotion co-ordinator of Chiap Hua, whose former lover is the defendant's boyfriend.

ICAC inquiries revealed that Chiap Hua had never employed the defendant as its staff.

An ICAC spokesman noted that over the past two years, 11 persons, including Kwok, were prosecuted for making false reports to the ICAC. Nine of them were convicted or pleaded guilty, and were given sentences ranging from community service to six months ' imprisonment.

The prosecution was today represented by ICAC officer Ying Chi-tat.
