Manager gets 8 months for accepting illegal rebates to award knitting orders

A production manager of a garment manufacturing firm was today (Thursday) jailed for eight months at North Kowloon Court for accepting illegal commission totalling $24,500 as rewards for placing orders with a knitting factory.
Yung Ming-po, also known as Yung Hang, 51, of Fang Brothers Knitting Limited (Fang Brothers), was today found guilty on six counts of accepting an advantage, contrary to Section 9(1)(a) of the Prevention of Bribery Ordinance.
Magistrate Mr Boey Chung said the offences committed by the defendant were serious.
In sentencing, the magistrate cited a guideline laid down by the Court of Appeal that bribery offences in the private sector warranted immediate custodial sentences.
The magistrate added that he had taken into consideration the defendant's clear records.
The court heard that Yung was responsible for placing orders with knitting factories.
On six occasions between April 1995 and August 1997, Yung had accepted illegal commission totalling $24,500 as rewards for placing orders with Ying Tung Knitting Factory (Ying Tung).
The owner of Fang Brothers confirmed that no permission was given to Yung to accept commission from Ying Tung.
The prosecution was today represented by Earnest Cheung on a fiat, assisted by ICAC officer Holman Ho.
