Wanted subcontractor arrested and charged for alleged $2m bribery scam over HD projects

The ICAC today (Tuesday) arrested a subcontractor of the Housing Department (HD) for allegedly offering $2 million in bribes to an HD Architect and soliciting bribes from other subcontractors in connection with HD development projects in Fanling and Tin S hui Wai.
Andy Chan Shu-ming, 46, proprietor of Good Year Professional Services Company (Good Year), who was earlier wanted by the ICAC, was arrested at the Hong Kong-Macau Ferry Terminal upon his return today.
Chan was subsequently charged with one count of offering an advantage to a public servant, and one of conspiracy to solicit advantages for a public servant.
He was remanded in the custody of the ICAC, pending his appearance in Eastern Court at 2:30 pm tomorrow (Wednesday) .
One of the charges alleged that Chan had offered $2 million to HA Architect Tjong Kee-ming as a reward for Tjong to use his position and influence to assist Good Year in being appointed as the subcontractor of the carpark deck coating and fire protection works to be carried out at the HD housing project at Tin Shui Wai Area 102 Phase 7.
The other charge alleged that Chan had conspired with another HD Architect Barry Tang Hoi-on and another subcontractor Chan Ka-ning to solicit advantages from other HD subcontractors for Tang as rewards for him to use his position and influence to cause t he use of material for which either Chan Shu-ming or Chan Ka-ning was an agent at the HD housing project at Fanling Area 49A Phase 2.
The advantages were said to be amounts of money as might be agreed to be paid by the subcontractors for their being awarded with the subcontracts for works carried out at the HD developments projects at Fanling and Tin Shui Wai.
The alleged offences took place between August 1, 1998 and April 23, 2001.
Chan Shu-ming was amongst 12 persons arrested by the ICAC in August last year, including Tang and Tjong.
He was subsequently released on ICAC bail pending further inquiries. In April this year, he refused to have his bail conditions extended. The ICAC later lost contact with the suspect.
Last Tuesday, the Eastern Court issued a warrant for the arrest of Chan Shu-ming at ICAC's application.
Tang, 35, and Tjong, 37, were earlier found guilty at the District Court of accepting meals, nightclub entertainment and hostess escort services from HD contractors for providing favourable treatment at the two projects. They were jailed for two years an d two and a half years respectively.
Meanwhile, Tang was also charged in connection with the same investigation. He faced four charges, including conspiracy to accept advantages, conspiracy to solicit advantages and conspiracy to offer advantages to a public servant. Trial was set for Janu ary 14, 2002.
