General manager gets 27 months for offering $150,000 to secure works contracts

A general manager of a management company was today (Monday) sentenced to 27 months' imprisonment at District Court for offering $150,000 to secure consultancy and electrical works contracts for two residential buildings in Kwai Chung.
Yip Hon-wing, 40, of Alico Management Company Limited (Alico), was today found guilty of one count of offering an advantage, contrary to Section 9(2)(a) of the Prevention of Bribery Ordinance.
He was arrested in an ambush operation after passing part of the bribe money to the chairman of an Incorporated Owners (IO).
Judge Colin MacKintosh said a firm sentence was imposed to deter and discourage such kinds of corruption cases.
The court heard that Alico provided management services to Cheong Wang Mansion and Cheong Wai Mansion in Castle Peak Road, Kwai Chung.
In April last year, Alico assisted the IO of the two buildings in inviting tenders for consultancy work in relation to electrical repairing works for the buildings.
In the following month, Archidesign and Associates Limited (A&A) operated by Yip and two other companies were shortlisted to present their proposals to the IO.
Yip told IO chairman Li Hoi that he could recommend a consultant for the project.
Li asked Yip to follow up the matter with another IO member Man Lui-on who had experience in this field.
Yip told Li that "This is outside money. Should you co-operate with me, we'll make money together."
On May 16 last year, the defendant met Li at a restaurant in Yaumatei, where the defendant asked Li to select A&A for the consultancy work and promised to offer Li monetary rewards.
Four days later, the defendant met Li and gave $37,500 in cash to Li inside a washroom of the restaurant.
The defendant told Li that it was the first instalment only, and that if either A&A or another contractor recommended by him was selected as the consultant, he would pay Li another $37,500.
The defendant also told Li that if a contractor recommended by him was selected to carry out the repairing works as well, he would pay another $75,000.
The defendant also suggested that out of the total bribe of $150,000, Li and Man should respectively get $100,000 and $50,000 as rewards.
The defendant was arrested by ICAC officers at the scene after he handed the first instalment of $37,500 to Li.
The prosecution was today represented by Paul Leung on a fiat, assisted by ICAC officer Patrick So.
