Tunnel officer jailed for perversion over traffic accident

An officer of the management company of Tseung Kwan O Tunnel was today (Friday) jailed for six months at Kwun Tong Court for perversion by giving a false statement about a traffic accident to the police.

Ting Tung-wong, 39, Traffic Officer I of China Tollways Limited, was earlier found guilty of one count of doing an act tending and intended to pervert the course of public justice, by falsely stating to the police that neither of the drivers of the two ve hicles involved had told him about the course of the accident.

Magistrate Mr Ken Ng Kin-man said he took a six-month jail term as the starting point and gave no discount to the sentence, since the perversion offence was serious and the defendant did not show any remorse over his act.

The court heard that Ting was responsible for controlling traffic at Tseung Kwan O Tunnel.

On September 8, 1999, a traffic accident involving a private car and a KMB bus occurred near an auto toll booth at the tunnel. Both vehicles were slightly damaged, but no casualty was reported.

Ting made record of both drivers' particulars and conducted separate enquiries with them.

Both drivers separately made a report to the police. A police officer in charge of the case interviewed Ting and took a statement from him regarding the accident.

In the statement, Ting falsely stated that he had not made any enquiries with the drivers and neither of the drivers told him about the matter.

Based on the information from Ting, his supervisor Kwok King-yin made a traffic accident damage report for submission to the police.

In the report, Kwok also added that after the accident, he interviewed the private car driver, Ho Kin-wah, who admitted that he had cut the lane and caused the accident.

As a result of the report, Ho was summoned for careless driving.

Ho pleaded not guilty, and the trial was scheduled for April 2000. The prosecution then offered no evidence against him after Kwok who was a witness failed to testify in court.

Ho lodged a complaint with the ICAC, alleging that Kwok and Ting had accepted advantages from the bus driver, Tong Pin, to give false statements to the police.

When interviewed by the ICAC, Ho denied having admitted that he had cut the lane, while Tong also stated that he did not hear Ho had made such admission.

The prosecution was today represented by a court prosecutor, assisted by ICAC officer Dickson Liang.
