Supplier sentenced for bribing former Ocean Park manager for contracts

A Chinaware supplier received a suspended sentence today (Thursday) for bribing a former manager of the Ocean Park in return for contracts for the supply of Chinaware, teapots and wineglasses to the Chinese restaurant in the Park.
Chiu Yu-Churk, 68, pleaded guilty at the Kowloon City Magistracy to eight counts of offering an advantage to a public servant as an inducement to or reward for giving assistance in regard to contracts, contrary to Section 5(1)(a)(i) and 12(1) of the Preve ntion of Bribery Ordinance.
Magistrate Mr Patrick Li sentenced Chiu to six months imprisonment, suspended for two years.
The court heard that Chiu was the sole proprietor of Tai Sang Company (Tai Sang), an approved supplier of the Ocean Park Corporation (Ocean Park).
Through official contact, Chiu came to know Tsui Wai-chung, then Food Operations Manager of Ocean Park’s Food Services Department responsible for selecting suitable suppliers to bid for purchase orders.
The court was told that in mid 1999, Tsui had asked Chiu to pay him a 10 per cent commission of the sales amount for every purchase order awarded to his company in return for his assistance.
Between June 2000 and April 2001, Chiu paid a total of $6,236.30 to Tsui by cheques payable to the companies controlled by Tsui.
Tai Sang has been awarded eight purchase orders of Chinaware, teapots and wineglasses, worth $62,342.80 in total.
Chiu was arrested in an operation mounted by the ICAC last November.
The case arose from a corruption complaint, alleging corrupt dealings between a manager of the Ocean Park and a number of contractors of the Ocean Park in the award of Ocean Park contracts.
The prosecution was represented by Senior Government Counsel Frederick Chung and assisted by ICAC officer Michael Tsoi.
