32 months' jail for former technician taking bribes for awarding bogus contracts

A former technician, charged by the ICAC, was today (Thursday) sentenced to 32 months' imprisonment for soliciting and taking bribes from two subcontractors for awarding bogus maintenance contracts at The Belcher's in Pokfulam.

Chung Yau-fuk, 39, formerly employed by Shun Tak Property Management Limited (Shun Tak), today pleaded guilty to seven charges, including soliciting and accepting advantages as an agent, deception and theft.

In sentencing, District Court Judge Lee Wai-chi said the starting point of four years was reduced to 32 months, taking into consideration the defendant’s guilty plea.

The court heard that in 2001, the defendant, while employed by Shun Tak as a maintenance technician at The Belcher's, invited two engineering subcontractors to place tender for replacing 7,200 transformers at the residential complex.

The defendant asked the subcontractors respectively for a rebate of one dollar to two dollars for each transformer replaced, and one percent to five percent of the total contract value of $417,600.

On another occasion in August 2001, the defendant solicited $50,000 from one of the subcontractors for awarding the relevant contract, and subsequently accepted $25,000.

The defendant later asked the subcontractor for a "deposit" of $50,000 for the works awarded, and misappropriated a cheque for the same amount.

The court also heard that on separate occasions, the defendant had obtained a total of $50,000 from the other subcontractor, falsely representing that $25,000 of which was a deposit for works awarded, while the remaining $25,000 was an inspection fee requ ired by Shun Tak for examining the new transformers.

Shun Tak confirmed that the project of replacing transformers did not exist, the court was told.
