Four months' jail for ex-merchandising manager soliciting illegal kickbacks

A former merchandising manager of a clothing company was today (Monday) sentenced to four months' imprisonment at Kwun Tong Magistracy for soliciting over HK$110,000 in illegal commissions for placing US$720,000 worth of purchase orders with a supplier.

Au Wai-chung, 42, formerly employed by Vietnam National Textile and Garments (HK) Limited (VTG), earlier pleaded guilty to two counts of soliciting an advantage as an agent, contrary to Section 9(1)(a) of the Prevention of Bribery Ordinance.

The court ordered that two other charges of conspiracy to solicit an advantage and conspiracy to defraud against the defendant be left on file.

In sentencing, Magistrate Mr Poon Siu-tung said in view of the seriousness of the bribery offences, he had no choice but to impose an immediate custodial sentence on the defendant.

The court heard that Au, while employed by VTG, had on two occasions between June and October 2001 solicited commissions from Max Light Industries Limited for placing two purchase orders for fabrics worth about US$722,720.

The commissions, amounting to about HK$112,455, were calculated at two per cent of the value of the purchase orders.

The court also heard that VTG prohibited its staff from soliciting and accepting rebates from suppliers.

The prosecution was today represented by Richard Donald on a fiat, assisted by ICAC officer Nicole Yip.
