Company director charged for alleged fraud over asbestos disposal at Aberdeen Tunnel

A director of an engineering company was today (Monday) charged by the ICAC for allegedly deceiving the Highways Department (HyD) over the disposal of asbestos wall panels inside the Aberdeen Tunnel.
Chan Chee-man, 40, director of Sonway Engineering Limited (Sonway), will appear before Eastern Magistracy at 9:30 am tomorrow (Tuesday) on one count of conspiracy to defraud HyD.
Sonway was earlier subcontracted to replace asbestos wall panels with Cemboard panels inside the tunnel, and was required to dispose of the asbestos waste in accordance with requirement of the Environmental Protection Department (EPD).
The charge alleged that Chan had conspired with other persons to defraud HyD by falsely representing that panels removed from the Aberdeen Tunnel pursuant to three HyD works orders had been disposed of in accordance with the Waste Disposal (Chemical Waste ) (General) Regulations, thereby deceiving HyD into releasing interim payments.
The alleged offence took place between April 25 and June 8, 2002.
The case arose from a corruption complaint, alleging that some HyD staff might have corruptly connived at non-compliant works inside the tunnel. ICAC inquiries revealed the alleged fraudulent scheme.
The defendant has been released on ICAC bail, pending his court appearance tomorrow.
