Three police officers and two others charged for alleged breach of PBO over disclosure of expenditures

Three police officers and two civilians, earlier arrested by the ICAC in relation to a corruption inquiry, were today (Thursday) charged for allegedly breaching Section 14(4) of the Prevention of Bribery Ordinance (PBO).

Sin Kam-wah, 45, Senior Superintendent; Ng Po-on, 39, Senior Inspector; Eddy Chan Chun-keung, 41, Station Sergeant; Che Kwai-wing, 47, housewife; and Lam Chuen-ip, 42, businesswoman, will appear at Eastern Court tomorrow at 9:30 am.

Under Section 14(1) of PBO, where there are reasonable grounds for suspecting that a person has committed an offence under PBO, the ICAC Commissioner, on an application to the Court of First Instance, may be authorised to serve a notice to require such pe rson to furnish a statement enumerating all his expenditures and liabilities.

Any person who fails to comply with a notice served under the provision is liable to prosecution under Section 14(4) of PBO.

The defendants were each charged with one count of failing to comply with a notice issued under Section 14(1) of PBO.

It was alleged that the defendants, having been served with a notice issued under the said PBO provision on September 16, 2002, failed to fully comply with the said notice without reasonable excuse.

They were said to have failed to enumerate all expenditure incurred by him / her, his / her spouse, his / her parents or children with regard to living expenses during the period commencing three years prior to the date of the said notice and ending on th e date of the said notice.

The alleged offences took place in October 2002.

The defendants have been released on ICAC bail, pending their court appearances tomorrow.

Meanwhile, the corruption inquiry by the ICAC is continuing.
