Three police officers and two others face court for alleged breach of PBO over disclosure of expenditures

Three police officers and two civilians, earlier arrested by the ICAC in relation to a corruption inquiry, appeared at the Eastern Magistracy this (Friday) morning for allegedly breaching the Prevention of Bribery Ordinance (PBO) over disclosure of their expenditures.

Sin Kam-wah, 45, Senior Superintendent; Ng Po-on, 39, Senior Inspector; Eddy Chan Chun-keung, 41, Station Sergeant; Che Kwai-wing, 47, housewife; and Lam Chuen-ip, 42, businesswoman, each pleaded not guilty to one count of failing to comply with a notice issued under Section 14(1) of PBO, contrary to Section 14(4) of the Ordinance.

Magistrate Mr David Dufton adjourned the case until April 25, 2003 for pre-trial review. The defendants were each granted cash bail of $5,000.

Under Section 14(1) of PBO, where there are reasonable grounds for suspecting that a person has committed an offence under PBO, the ICAC Commissioner, on an application to the Court of First Instance, may be authorised to serve a notice to require such pe rson to furnish a statement enumerating all his expenditures and liabilities.

Any person who fails to comply with a notice served under the provision is liable to prosecution under Section 14(4) of PBO.

It was alleged that the defendants, having been served with a notice issued under the said PBO provision on September 16, 2002, failed to fully comply with the said notice without reasonable excuse.

They were said to have failed to enumerate all expenditures incurred by him / her, his / her spouse, his / her parents or children with regard to living expenses during the period commencing three years prior to the date of the said notice and ending on t he date of the said notice.

The alleged offences took place in October 2002.

The prosecution was today represented by Government Counsel Marco Li, assisted by ICAC officer William Chan.
