Teacher faces court for allegedly soliciting illegal commission over purchase of musical instrument

A secondary school teacher, charged by the ICAC, appeared at Eastern Magistracy this (Friday) morning for allegedly soliciting illegal rebate over the purchase of a musical instrument which was financed by the Quality Education Fund (QEF).
Lam Mun-yee, 42, pleaded not guilty to one count of agent soliciting an advantage, under Section 9(1)(a) of the Prevention of Bribery Ordinance, and one of attempting to falsify accounts.
Magistrate Mr David Dufton adjourned the case until May 16, 2003 for pre-trial review, and granted the defendant $5,000 bail in cash.
The QEF requires that all purchases made under the fund be supported with invoices issued by the relevant suppliers.
The bribery charge alleged Lam of soliciting from Cheung Ka-fai an advantage over the purchase of a musical instrument, a marimba, which Lam made on behalf of the Aberdeen Baptist Lui Ming Choi College (Lui Ming Choi College) under the QEF.
Lam was further charged with attempting to falsify three invoices in the name of Professional Music Service (Professional), purporting to show that certain musical instruments named thereon were sold by Professional to Lui Ming Choi College respectively a t $18,390, $10,000 and $1,375.
The alleged offences took place between October 23 and October 25, 2002.
The prosecution was today represented by ICAC officer Joanne Tang.
