Trio charged by the ICAC for alleged voting offences at Kwun Yam Shan VR Election

Three registered voters of the 2003 Village Representative (VR) Election were charged by the ICAC for allegedly committing voting offences in the VR election for Kwun Yam Shan and Kong Pui, Shatin.

The defendants are: Wong Hon-tung, 29, tele-communication technician; Lee Mong-nga, 28, housewife; and Wong Yiu-cheong, 42, driver.

They will appear at Shatin Magistracy at 9:30 am tomorrow (Friday) in two separate cases, each facing one count of engaging in corrupt conduct with respect to voting at an election, contrary to Section 16(1)(b) of the Elections (Corrupt and Illegal Conduc t) Ordinance.

In the first case, Wong Hong-tung and Lee Mong-nga were alleged of having engaged in corrupt conduct at the 2003 Village Representative Election (Resident Representative) for Kwun Yam Shan and Kong Pui by voting at the election on July 20, 2003, after hav ing given to an electoral officer information that they knew to be materially false or misleading.

The alleged false information, contained in a declaration in their Applications for Voter Registration (Village Representative Election –'96 Resident Representative), purportedly showed that:

- the principal residential address of the defendants was a premises in Kwun Yam Shan Village;

- the said principal residential address was the only or main residence

of the defendants in Hong Kong; and

- the defendants had been residents of Kwun Yam Shan Village for the three years immediately before applying to be registered and were eligible to be registered as an elector for an existing village.

In the second case, Wong Yiu-cheong faced a similar charge involving another premises in Kwun Yam Shan Village.

The defendants are currently on ICAC bail, pending their court appearances tomorrow.
