Record company senior executive and two others face ICAC charges

A senior executive of a record company earlier arrested by the ICAC in a corruption inquiry was today (Tuesday) charged for allegedly soliciting and accepting bribe payments in relation to the contractual arrangement with an artiste.
Chan Sai-ming, 49, president of Universal Music Limited (UML), faces one count of soliciting $800,000 from To Kit-ho, and one of accepting $680,000 from To between May and July 2003, contrary to Section 9(1)(a) of the Prevention of Bribery Ordinance (PBO) .
The alleged bribes were said to be rewards for Chan to approve the alteration of the contractual relationship of Juno Mak Wun-yin with UML and expediting the termination of an Artiste Agreement between UML, Mak and Mellow Studio Limited and replacing it w ith a distribution agreement.
Meanwhile, two other individuals arrested in the same ICAC inquiry were also charged today.
Choi Hon-wah, 51, company director, faces one count of offering $90,000 to Chan Sai-ming on February 21, 2003 under Section 9(2)(a) of PBO.
The alleged bribe was said to be reward for Chan to assign to Chii Hang International Company Limited (CHICL) the copyright of certain songs that were the property of UML, and remain favourably disposed towards CHICL in future negotiations with Chan over the assignment of copyright owned by UML.
Cheung Hay-kin, 41, a driver, was charged with one count of disclosing the identity of a person being investigated by the ICAC, contrary to Section 30(1)(a) of PBO.
The charge alleged that Cheung, knowing or suspecting that an investigation in respect of an offence suspected to have been committed under Part II of PBO was taking place, without lawful authority or reasonable excuse, disclosed to Ho Lai-chuen that he w as the subject of such investigation on June 23, 2003.
The defendants, currently on ICAC bail, will appear at Eastern Magistracy at 9:30 am tomorrow (Wednesday) in separate cases.
