Marine Department officer and two others face ICAC charges over $2m purchase orders

A Supplies Supervisor I of the Marine Department (MD), his wife and a supplier were today (Monday) charged by the ICAC for alleged bribery, misconduct, and fraud in relation to the awarding of over $2 million worth of MD's purchase orders.

The defendants are Chan Chung-ching, 52, Supplies Supervisor I of MD; his wife Chan Ip Fung-hang, 52, proprietor of Castle Stamp & Design Company (Castle Stamp); and Susana Chan Siu-wai, 46, operator of Achievement Trading Company (Achievement).

They will appear at North Kowloon Magistracy at 9:30 am tomorrow (Tuesday) on a total of seven charges.

The defendants were arrested by the ICAC during a corruption inquiry in April last year.

Two of the charges allege that Chan Chung-ching, in the course of his public office, had wilfully and intentionally culpably misconducted himself in respect of the issue of purchase orders to Castle Stamp and Achievement.

The charges also allege Chan Chung-ching of failing to declare a conflict of interest arising from his relationship with the proprietors and operators of Castle Stamp and Achievement, and showing improper partiality towards Castle Stamp and Achievement.

One of the above charges also alleges Chan Ip Fung-hang and Chan Siu-wai of aiding and abetting Chan Chung-ching to commit the alleged misconduct offence in relation to purchase orders said to have been awarded to Achievement.

Chan Chung-ching and Chan Ip Fung-hang also face one count of conspiring together and with another person for Chan Chung-ching to accept periodic payments as rewards for recommending MD to issue purchase orders to Palmtop Stamp Company (Palmtop).

The remaining four charges allege Chan Chung-ching of having fraudulently induced MD to award purchase orders to Palmtop, Yan Shun Hardware, Eddie Company and Jit Shing Hong, by falsely representing to MD that genuine competing quotations higher in price than those provided by these suppliers had been obtained.

ICAC enquiries revealed that purchase orders awarded to these suppliers related to various items, including office equipment, electrical appliances, cleaning products as well as mechanical parts for vessel maintenance.

The alleged offences took place between January 1999 and April 2003.

The defendants are currently on ICAC bail, pending their court appearances tomorrow.
