Six charged for alleged fraud over electronic transactions with government

The ICAC has charged six persons for an alleged fraud to inflate the number of electronic transactions with government departments on a website to help its operator fulfill a requirement of a contract awarded by the then Information Technology and Broadca sting Branch (ITBB) (now known as the Communications and Technology Branch (CTB)) under the Commerce, Industry and Technology Bureau.

The defendants are Tony Ma Chung-kit, 38, chief operating officer of the ESD Services Limited (ESDSL); Marian Lam May-yun, 36, former marketing general manager of ESDSL; Wan Yuk-yin, 31, assistant manager of ESDSL; Lee Chun-man, 26, director of the Event Elite Production and Promotion Limited (EEPPL); Lee Shu-lun, 25, public relations manager of EEPPL; and Cherry Wong Wing-nga, 24, account executive of EEPPL.

They will appear in Eastern Magistracy at 9:30 am on Thursday (November 18, 2004) on a total of six offences –'96 one of conspiracy to defraud, two of forgery, two of using a false instrument, and one of possessing equipment for making a false instrument.

ESDSL was awarded an agreement by ITBB to set up and maintain a website for the public to make electronic transactions with government departments. EEPPL was subcontracted by ESDSL to promote the service.

Under the agreement, ESDSL was required to meet a certain number of chargeable transactions in order to receive a monthly subscription fee and a unit transaction fee from ITBB.

Ma, Lam, Wan, Lee Chun-man, Lee Shu-lun and Wong are jointly charged with one count of conspiring together to defraud CTB.

They are alleged to have falsely represented that more than 82 people had made a total of 81,341 bookings of sporting facilities of the Leisure and Cultural Services Department via the internet, and paid for the use of the facilities.

Wan and Lee Shu-lun face two joint charges of forgery, alleging them of making false documents purported to be quotations from two companies in relation to promoting the internet service.

ICAC enquiries revealed that the alleged forgery was to fulfill the quotation invitation requirements of ESDSL.

Wan further faces two counts of allegedly using the above false quotations.

Lee Chun-man alone faces one count of having in his custody a portable hard disk drive containing the false quotations, which to his knowledge was designed for making the false instruments.

The alleged offences took place between January and September last year.

The defendants have been released on ICAC bail, pending their court appearances on Thursday.
