Sham Shui Po District Councillor and three others charged for alleged false claims of expenses

A member of the Sham Shui Po District Council (SDC) and three other persons have been charged by the ICAC for allegedly making false claims of reimbursement of expenses totalling about $230,000 from SDC, the Food and Environmental Hygiene Department (FEHD ) and the Social Welfare Department (SWD) in relation to various activities organised by two non-profit making residents organisations.

The defendants are Leung Hon-wa, 41, a member of SDC and the chairman of the China Youth Services and Recreation Centre (CYSRC); Tse Yee-fong, 47, Jimmy Kong Wing-hong, 43, and Chan Tze-yui, 34, respectively secretary, treasurer and vice-chairman of CYSRC .

They will appear in North Kowloon Magistracy at 9:30 am on Friday (November 19, 2004) for plea on a total of 14 offences under the Theft Ordinance –'96 13 counts of furnishing false information, and one of conspiracy to furnish false information.

The defendants were earlier arrested by the ICAC during a corruption inquiry.

One of the charges alleges that Leung and Kong, in furnishing information for an application for reimbursement of expenses incurred at an activity organised by CYSRC, had dishonestly produced to SDC a number of receipts and cash memoranda, which to their knowledge were false.

The alleged false documents purportedly showed that the companies named had provided the respective services or products in relation to the activity, and that the expenses listed were incurred at the activity and paid for by CYSRC.

Leung, Tse, Kong and Chan face one joint charge of conspiracy to furnish false information, which alleges them of producing to SDC false or inflated invoices, receipts and cash memoranda in relation to 12 other activities organised by CYSRC.

Kong alone faces four counts of furnishing false information to FEHD and SWD for applications for reimbursement of expenses incurred at four activities organised by CYSRC.

Tse alone faces eight counts of furnishing false information to the then chairman of the United Association of Nam Cheong Middle West District and SDC for applications for reimbursement of expenses incurred at eight activities organised by the association .

ICAC investigation revealed that the alleged false claims from SDC and FEHD amounted to a total of about $197,800 and $29,900 respectively, while another $1,800 was deceived from SWD.

The alleged offences took place between September 1996 and March last year.

The defendants have been released on ICAC bail, pending their court appearances on Friday.
