Trio jailed for deceiving $6.5m commissions and transportation charges

Two former employees of Mitsubishi Corporation (Hong Kong) Limited (Mitsubishi-HK) and a merchant, charged by the ICAC, were today (Friday) sentenced to jail terms up to four years at District Court for deceiving commissions and transportation charges tot alling about $6.5 million from Mitsubishi-HK.

Harry Cheung Kuen, 41, a former deputy general manager of Mitsubishi-HK, and Dennis Cheung Hang, 40, a merchant, were each sentenced to four years' imprisonment.

Choi Pui-chung, 43, another former deputy general manager of Mitsubishi-HK, was jailed for three years.

In sentencing, Judge Gill said the offences committed by the defendants constituted a serious breach of trust, adding that the fraud was premeditated.

The defendants were today found guilty of three offences –'96 two counts of conspiracy to defraud, and one of conspiracy for an agent to use documents with intent to deceive his principal.

The defendants were arrested by the ICAC during a corruption inquiry in July last year.

One of the charges stated that Cheung Kuen and Cheung Hang had conspired with other persons to defraud Mitsubishi-HK by dishonestly causing Mitsubishi-HK to pay a total of $1,951,985.59 pursuant to commission agreements allegedly made based on false repre sentations.

Cheung Kuen and Cheung Hang further faced one count of conspiring with other persons for Cheung Kuen to use the alleged false commission agreements, with intent to deceive Mitsubishi-HK.

Cheung Kuen, Cheung Hang and Choi were convicted on a joint charge of conspiring with other persons to defraud Mitsubishi-HK by dishonestly causing Mitsubishi-HK to pay inflated transportation charges totalling $4,565,693.05.

The conspiracy offences took place between January 1997 and July 2003.

Mitsubishi-HK had rendered full assistance to the ICAC during its investigation into the case.

The prosecution was today represented by Charlotte Draycott, counsel on fiat, assisted by ICAC officer Keith Leung.
