Ex-project manager of design company gets 4 years for deceiving $129,000 with inflated quotations

A former project manager of an interior design company, charged by the ICAC, was today (Friday) sentenced to four years' imprisonment at District Court for submitting inflated quotations to deceive a total of about $129,000 from the company.

Kenneth Ho Kin-hang, 41, formerly employed by RHK Design Limited, was found guilty of 12 counts of agent using document with intent to deceive his principal, contrary to Section 9(3) of the Prevention of Bribery Ordinance.

In sentencing, Judge Toh said a deterrent sentence must be imposed on the defendant in view of the serious breach of trust and the premeditated scam.

The court heard that while employed by RHK, the defendant was responsible for liaising with and obtaining quotations from subcontractors, and supervising their work.

RHK would provide sub-contractors with all kinds of drawings and layout plans, free of charge, that were necessary for completion of their jobs, while employees of the company were prohibited to solicit or accept advantages in relation to the company's bu siness.

The court heard that since late 2002, the defendant had, on a number of occasions, invited quotations from a proprietor of a furniture company for orders of curtain installation.

The defendant told the proprietor that he would inflate the quotations submitted, claiming that he would provide "consultation services".

The proprietor, upon receiving payment from RHK, was asked to refund the inflated amounts to the defendant.

The court also heard that in May 2003, the defendant requested two other company proprietors to submit inflated quotations for the installation of a security system and an air-conditioning system.

They were asked to pay the inflated amounts, purporting to be "drawing fees", to a BVI company set up by the defendant.

The defendant had deceived a total of about $129,000 from RHK through the above fraudulent means, the court was told.

The prosecution was today represented by Bernard Yuen, counsel on fiat, assisted by ICAC officer Whammy Yu.
