Ex-sales executives of TDC charged for alleged false claims of commissions

The ICAC has charged three former sales executives of the Hong Kong Trade Development Council (TDC) for allegedly obtaining commissions by fraudulent means in relation to placement of advertisements in various TDC publications.

Simon Ng Kam-fai, 32, Lee Kam-wing, 26, and George Leung Chi-on, 24, all former sales executives of the Publications Department of TDC, will appear in Eastern Magistracy at 9:30 am next Monday (April 11) on a total of four alleged offences –'96 two of conspiracy to defraud and two of fraud.

The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the alleged fraud offences.

One of the charges alleges that Ng and Leung had conspired to defraud TDC by falsely representing that an advertisement order contract signed between TDC and a company had been secured by Ng, thereby deceiving TDC into paying him a commission.

Lee and Leung face a similar joint charge of conspiracy to defraud involving two other advertisement order contracts.

Lee further faces two counts of fraud which allege him of falsely representing to TDC that three other advertisement order contracts had been secured by him, and inducing TDC to approve and pay him commissions.

The commissions involved in the above alleged offences were calculated at the rate of 13 per cent of the value of the contracts.

ICAC enquiries revealed that as a result of the alleged fraudulent scam, TDC was misled into paying commissions totalling over $9,700 to the defendants.

The alleged offences took place between April and December 2003.

The defendants have been released on ICAC bail, pending their court appearances on Monday.
