Duo guilty of inciting CSD officer to bring cash and cigarettes into correctional institution

A man and a woman, charged by the ICAC, were today (Monday) convicted at District Court of conspiring to incite an officer of the Correctional Services Department (CSD) to introduce $150,000 cash and 200 packets of cigarettes into Lai Sun Correctional Ins titution.

Lee Kin-wai, 21, a prisoner, and Au Siu-mui, 51, a housewife, were found guilty of one count of conspiracy to incitement.

Lee earlier pleaded guilty to one count of offering an advantage to a public servant, contrary to Section 4(1)(a) of the Prevention of Bribery Ordinance.

Judge Mary Wu adjourned the case until May 9, 2005 for sentence, pending a community service order report on Au.

Lee is serving his jail term in connection with a Police case, while Au was released on cash bail of $10,000, pending sentence.

The court heard that at the time of the offences, Lee was a prisoner at Lai Sun Correctional Institution, while Au was the mother of another inmate with whom Lee was acquainted.

In April last year, Lee, on a number of occasions, approached an Assistant Officer II of CSD and repeatedly asked the officer to supply him with cigarettes for a bribe.

The officer reported the incident to his supervisor and the case was then referred to the ICAC for investigation. CSD offered full assistance to the ICAC during the investigation.

The court heard that on May 5 last year, Lee offered $50,000 to the CSD officer for bringing him 200 packets of cigarettes and $150,000 cash into the correctional institution.

Lee also made arrangement for Au to meet the CSD officer so that Au could pass the money to the officer.

On May 27 last year, Au met the CSD officer in Central and gave him two envelopes containing $200,000 cash, telling him to convey the money to Lee. Au was then arrested by ICAC officers.

When interviewed under caution, Lee admitted that he had offered monetary rewards to the CSD officer for introducing cigarettes into the correctional institution.

Lee also admitted that he had asked Au to give $200,000 cash to the officer, of which $150,000 was to be passed to Lee in prison.

The prosecution was today represented by Susanna Ku, counsel on fiat, assisted by ICAC officer Kenny Tse.
