Businessman faces court for allegedly bribing C&E officer

A businessman, charged by the ICAC for allegedly offering bribe payments to an officer of the Customs & Excise Department (C&E) for obtaining restricted information on textile companies under investigation and the duty roster of the officer, today (Friday ) appeared at the Kowloon City Magistracy on two corruption charges.

Tang Kwok-wai, 41, faced two counts of conspiracy for a public servant to accept advantages, contrary to Section 4(2)(a) of the Prevention of Bribery Ordinance.

No plea was taken today. Magistrate Mr Ernest Lin adjourned the case to June 24, 2005 for plea at the District Court.

The defendant was granted cash bail of $20,000. He was also ordered not to leave Hong Kong and not to interfere with prosecution witnesses.

One of the charges alleged Tang of conspiring with Len Sing-yan, then an Assistant Trade Controls Officer of C&E, for Len to accept bribe payments in the aggregate sum of about $12,000.

The alleged bribes were for Len to use his position to help retrieve restricted information in respect of a number of textile companies under investigation by the Trade and Industry Department.

The remaining charge alleged Tang of conspiring with Len for the latter to accept periodic payments in the aggregate sum of about $70,000, as rewards for Len to supply information about the duty rosters of the Textiles Tactical Strike Units of C&E.

The alleged offences took place between October 2003 and September 2004.

Len, who was also charged by the ICAC for his role, earlier pleaded guilty and was sentenced.

The prosecution was today represented by ICAC officer Alice Wong.
