Barrister charged for allegedly obtaining professional training by fraudulent means

A barrister was today (Friday) arrested by the ICAC and brought to court for allegedly obtaining his professional training by fraudulent means.

Larry Yeung Hon-keung, 40, appeared in Eastern Magistracy this afternoon on five counts of offences –'96 obtaining services by deception, using a false instrument, forgery, fraud and false accounting.

No plea was taken. Magistrate Mr Ian Candy adjourned the case until September 30, 2005 for plea at District Court, and granted the defendant cash bail of $20,000.

He was also ordered not to leave Hong Kong, not to interfere with prosecution witnesses, to reside at his present address and to inform the ICAC 24 hours prior to any change of address.

The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the alleged offences.

One of the charges alleged that Yeung had dishonestly obtained from the University of Hong Kong (HKU) by deception an education, including lectures and tutorials provided to him for the part-time course of Postgraduate Certificate in Laws (the PCLL course ).

Yeung was alleged to have falsely represented that he was then employed by a hotel as "legal manager", and that his employer had agreed to release him to attend the PCLL course.

He was also alleged to have dishonestly failed to disclose to HKU that his genuine employment then was a full-time teacher of the Education Department (ED).

The second charge alleged Yeung of using a letter, purportedly issued by the hotel and which he knew to be false, with the intention of inducing members of the PCLL Admissions Committee of HKU to accept it as genuine.

The third charge alleged that Yeung, together with another person, had forged another letter purportedly issued by the hotel for the same reason.

Yeung was also alleged to have induced ED to grant or continue to grant him no-pay study leave, by falsely representing that he intended to apply for and use the no-pay study leave to attend a course related to education or relevant to his duties as a tea cher employed by ED, and dishonestly omitted to disclose to ED that he had already been admitted to the PCLL course with HKU.

The remaining charge alleged Yeung of falsifying an application form for the no-pay leave.

The alleged offences took place between February 2000 and September 2002.

The prosecution was today represented by ICAC officer Kelvin Choi.
