Four face court for alleged fraud over subcontracting FEHD $106m cleaning contracts

Four persons, charged by the ICAC for allegedly conspiring to defraud the Food and Environmental Hygiene Department (FEHD) in relation to the subcontracting of seven FEHD cleaning contracts worth over $106 million, appeared in Eastern Magistracy today (Th ursday).
The defendants were Ha Kam-kaye, 71, general manager of Wai Hong Waste Management Limited (Wai Hong Waste); Wong Siu-sing, 42, operator of A&T Service Company (A&T); Ng Wai-ming, 38, proprietor of Ming Kee Cleaning Services Limited (Ming Kee); and Tam Man -kwong, 56, proprietor of Wai Shing Cleaning Company (Wai Shing).
Ha faced three counts of conspiracy to defraud, while the remaining defendants were each charged with one similar offence.
No pleas were taken. Magistrate Mr Ian Candy adjourned the case until November 3, 2005, pending transfer to District Court.
The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the alleged fraud offences.
FEHD requires that its cleaning contractors shall not subcontract any part of a cleaning contract to others without the prior approval of the Department.
Wai Hong Waste was a subsidiary of Wai Hong Cleaning & Pest Control Company Limited (Wai Hong), whereas A&T, Ming Kee and Wai Shing were allegedly recruited by Ha as subcontractors to carry out FEHD cleaning contracts for Wai Hong.
One of the charges alleged that Ha and Wong had conspired with other persons to defraud FEHD by falsely representing that Wong and the cleaning workers recruited by him were all employees of Wai Hong.
They were alleged to have concealed from FEHD that the two contracts for the provision of cleaning services awarded by FEHD to Wai Hong by way of tender had been subcontracted to Wong.
They were also alleged to have falsely represented that the contracts were performed by Wai Hong, causing FEHD not to take proper action against Wai Hong.
Ha and Ng was charged with a similar offence as to the subcontracting of three other FEHD cleaning contracts.
Ha and Tam faced another similar offence in relation to the subcontracting of two other FEHD cleaning contracts.
The alleged offences took place between June 2001 and October last year.
ICAC enquiries revealed that the seven FEHD cleaning contracts concerned were valued at over $106 million.
Ha, Ng and Tam were each granted cash bail of $50,000, while Wong was on cash bail of $30,000. The defendants were also ordered not to interfere with prosecution witnesses.
The prosecution was today represented by ICAC officer Andy Yu.
