Construction company director jailed for bribery over renovation contract

A director of a construction company, charged by the ICAC, was today (Wednesday) sentenced to nine months' imprisonment at Kowloon City Magistracy for offering bribes to the chairman and treasurer of the incorporated owners (IO) of a private residential b uilding for securing a renovation contract.

Chan Kong-sing, 39, a director of Wide Project (Hong Kong) Limited (Wide Project), was today found guilty by Magistrate Mr Ernest Lin of three counts of offering an advantage to an agent, contrary to Section 9(2)(a) of the Prevention of Bribery Ordinance.

The court heard that in June last year, the IO of Kam Fai Building at Waterloo Road, Yaumatei, employed a consultant firm for a renovation project of the building after a tendering exercise.

Two months later, the consultant firm put up an advertisement inviting contractors to submit tenders to bid for the renovation contract.

A total of 11 contractors, including Wide Project, had submitted their tenders. The quotation of Wide Project was $1,861,000.

In early September last year, the consultant firm shortlisted three contractors. Wide Project was not included in the list.

At a meeting with the IO chairman of the building on September 23 last year, Chan offered an advantage, equivalent to five per cent of the renovation contract value, in return for the chairman's assistance in procuring the contract for Wide Project.

The court heard that at the same meeting, Chan also asked the chairman to approach the treasurer of the IO to persuade other IO members to select Wide Project as the contractor of the renovation project.

Chan also offered the treasurer a sum of money, equivalent to the share in the contribution toward the renovation fee due from a household of the building as a reward.

On October 12 last year, the chairman and treasurer of the IO attended another meeting with Chan at a restaurant.

At the meeting, Chan again brought up the subject and offered them five per cent of the value of the renovation contract for the same reason.

The IO of the building prohibited its members from soliciting and accepting any advantages in relation to its affairs and business, the court was told.

The prosecution was today represented by Government Counsel Ned Lai, assisted by ICAC officer Mon Chan.
