Five penalised for breach of PBO over disclosure of expenditures

Five persons, including a former Senior Superintendent of Police and two serving police officers, charged by the ICAC, were today (Wednesday) each fined $10,000 at Kowloon City Magistracy for breaching the Prevention of Bribery Ordinance (PBO) over disclo sure of their expenditures in relation to a corruption investigation.
The defendants were Sin Kam-wah, 48, former Senior Superintendent of Police; Ng Po-on, 41, Senior Inspector; Eddy Chan Chun-keung, 44, Station Sergeant; Che Kwai-wing, 50, housewife; and Lam Chuen-ip, 45, businesswoman.
They were each found guilty by Magistrate Mrs Adriana C. Tse on one count of failing to comply with a notice issued under Section 14(1) of PBO, contrary to Section 14(4) of the Ordinance.
The charge stated that on October 11, 2002, the defendants, having been served with a notice issued under Section 14(1) of PBO on September 16, 2002, failed to fully comply with the notice without reasonable excuse.
The defendants had failed to enumerate all expenditures incurred by themselves / their spouses, their parents or children with regard to living expenses during the period commencing three years prior to the date of the notice and ending on the date of the notice.
The prosecution was today represented by Senior Assistant Director of Public Prosecutions Ian McWalters and Senior Government Counsel Marco Li, assisted by ICAC officer William Chan.
