FSD Senior Divisional Officer alleged of misconduct in public office

A Senior Divisional Officer of the Fire Services Department (FSD) has been charged by the ICAC today (Wednesday) for alleged misconduct in public office in relation to his involvement in the implementation of the Department's Third Generation Mobilizing S ystem (TGMS).

Tung Tung-san, 48, will appear at Kowloon City Magistracy at 9:30 am on Friday (March 10) on one count of misconduct in public office, and two alternative charges.

Tung is alleged to have wilfully and intentionally misconducted himself in the course of his public office between February 2001 and May 2005.

The charge alleges that Tung had dishonestly caused the award of a contract by Singapore Engineering Software Pte. Ltd. (SES) to MediAdvertising (HK) Ltd. (MAL) for organising a contract-signing ceremony to mark the launching of FSD's TGMS project.

Tung is alleged to have failed to declare to FSD and/or SES a conflict of interest arising from his sibling relationship with Ronny Tung Mei-yi, a shareholder and director of MAL, and falsely represented to SES that MAL had previously organised similar ev ents for FSD.

The same charge also alleges Tung of unlawfully keeping for himself two computers and an LCD monitor which had been given for his temporary use by SES in relation to the TGMS project.

The defendant is also alleged to have improperly authorized the full release of the fourth milestone payment to SES for a sub-system of TGMS, knowing that only 70% of the works had been completed and without obtaining the necessary approval for variation of contract payment terms.

The charge also alleges Tung of soliciting and accepting from the vice president of SES an employment for his daughter at the headquarters of SES in Singapore.

Tung also faces an alternative charge of misconduct in public office in relation to the contract-signing ceremony for the launching of TGMS.

Another alternative charge alleges Tung of accepting two computers and an LCD monitor from the vice president of SES without the general or special permission of the Chief Executive.

FSD had rendered full assistance to the ICAC during the investigation.

The defendant has been released on ICAC bail, pending his court appearance on Friday.
