School administrative staff jailed for bribery over service contracts

A school administrative staff, charged by the ICAC, was today (Friday) jailed for eight months at Eastern Magistracy for accepting a $100,000 loan from a cleaning contractor for renewing service contracts of the school for longer terms without consent of the school.
Jung Chul Woo, 49, yesterday pleaded guilty to two counts of agent accepting an advantage, contrary to Section 9(1)(a) of the Prevention of Bribery Ordinance. The offences took place between July and December 2005.
Magistrate Mr Alan Wyeth also ordered the defendant to pay $15,600 in restitution to the school.
The court heard that at the time of the offences, the defendant was responsible for overseeing the awarding of service contracts of the school, including cleaning and security guarding services, as well as the supply of caretakers.
In July 2005, the defendant approached Wong Kam-shing, operator of Master Gold Cleaning Services Company Limited (Master Gold), Smart Light Security & Property Management Services Limited (Smart Light) and Tung Chun Engineering & Consultants Limited (Tung Chun) for a loan of $100,000.
At that time, Master Gold, Smart Light and Tung Chun were contractors respectively for cleaning, security, and property management services of the school.
The defendant agreed to Wong's condition that instead of renewing the service contracts concerned yearly, the three companies be awarded contracts for a two-year term.
In August 2005, the defendant renewed service contracts respectively with Master Gold, Smart Light and Tung Chun for two years.
The court also heard that in December 2005, after paying three or four monthly instalments of $3,000 to Wong, the defendant told Wong that he was unable to make further repayments.
Wong told the defendant he would forgo the outstanding amount of the loan on the condition that the monthly cleaning fee for the school be increased by $2,600, and that the contract with Master Gold be extended to three years.
The defendant agreed. He made out a new three-year cleaning contract with Master Gold, with the monthly cleaning fee increased from $51,680 to $54,280.
The prosecution was today represented by ICAC officer Marcus Leung.
