Six charged for allegedly defrauding Highways Department over road resurfacing works

Six employees of an asphalt company were today (Tuesday) charged by the ICAC with conspiracy to defraud the Highways Department (HyD) in relation to road resurfacing works.

Cheng Chi-fai, 53, manager of Wui Yip Asphalt (H.K.) Limited (Wui Yip); Tsui Yau-chuen, 53, and Wong Kwong-sing, 42, both foremen of Wu Yip; Chow Heung-fai, 34, Leung Shing-cho, 43, both site agents of Wui Yip; and Cheng Ka-man, 33, worker of Wui Yip, wil l appear in Shatin Magistracy at 9:30 am on Thursday (August 10) for plea.

Wu Yip was a subcontractor of HyD to perform road resurfacing works at various sites throughout the territory.

The case arose from a corruption complaint earlier received by the ICAC. Subsequent enquiries revealed the alleged conspiracy offence.

The six defendants face one joint charge, which alleges them of conspiring with other persons to defraud HyD between January 1, 1999 and September 12, 2005.

They are alleged to have falsely represented that the core samples submitted to the Public Works Laboratory for testing by Wui Yip were actual core samples obtained from the respective HyD sites at which bituminous road resurfacing works were carried out by Wui Yip.



As a result of the alleged false representation, HyD was deceived into accepting the submitted samples and the test results of the same as genuine.

The six defendants have been released on ICAC bail, pending their court appearances on Thursday.
