Ex-Deputy Privacy Commissioner charged for alleged misconduct and false claims over subsistence allowance

The former Deputy Privacy Commissioner for Personal Data has been charged by the ICAC for alleged misconduct in public office and using false documents to deceive overseas subsistence allowance.
Anthony Lam Wing-hong, 58, will appear in Eastern Magistracy at 9:30 am tomorrow (Thursday) on one count of misconduct in public office, contrary to Common Law, and three of agent using document with intent to deceive his principal, contrary to Section 9( 3) of the Prevention of Bribery Ordinance.
One of the charges alleges that between February 8 and July 12, 2005, Lam, being the Acting Privacy Commissioner for Personal Data, had wilfully and intentionally culpably misconducted himself.
He was alleged to have dishonestly claimed the cost of return airfares for travel from Hong Kong to Melbourne, Australia to attend meetings, and to have dishonestly claimed 100% overseas subsistence allowance to cover the cost of his accommodation, meals and other expenses whilst attending the meetings.
The remaining three charges allege that between August 11, 2001 and October 20, 2003, Lam, being the Deputy Privacy Commissioner for Personal Data, had used false documents to apply for overseas subsistence allowance, with intent to deceive the Privacy Co mmissioner for Personal Data.
The said documents contained alleged false statements that he was entitled to overseas subsistence allowance totalling AUS$4,288.
The defendant has been released on ICAC bail, pending his court appearance tomorrow.
