Lands Department officer faces court for misconduct over small house applications

A Senior Land Executive of the Lands Department, charged by the ICAC for alleged misconduct in public office in relation to applications for building small houses, appeared in Tuen Mun Magistracy today (Friday).
Tang Chung-ming, 47, faced one count of misconduct in public office, contrary to Common Law.
The defendant pleaded not guilty to the charge. Magistrate Mr Kwok Wai-kin adjourned the case until March 5, 2007 for a pre-trial review. The trial was set for May 14 and 15, 2007.
The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the alleged misconduct offence.
The charge alleged that on May 2, 2002, Tang, who was then a Land Executive of the Lands Department, in the course of his public office, had wilfully and intentionally culpably misconducted himself.
Tang was said to have obtained from another Senior Land Executive the land status plans and current ground information in respect of a short-term tenancy at Kam Tin, which was the official and internal information of the Lands Department, and to have used that information to make three applications to the District Lands Office of Yuen Long to build small houses for himself and two other family members.
The defendant was granted cash bail of $5,000. He was also ordered not to interfere with prosecution witnesses.
The prosecution was today represented by ICAC officer Kinte Chan.
