Student penalised for impersonation in HKCEE

An associate degree student, charged by the ICAC, was today (Monday) sentenced at Tuen Mun Magistracy for impersonating another candidate in the Hong Kong Certificate of Education Examination (HKCEE).

Leung Hoi-ting, 20, was ordered by Magistrate Mr Clement Lee Hing-nin to perform 240 hours of community service. She earlier pleaded guilty to one count of conspiracy to defraud the Hong Kong Examinations and Assessment Authority (HKEAA).

Co-defendant Yuen Wai-chi, 20, who had requested Leung to impersonate her in the examination, was earlier sentenced to 80 hours of community service after pleading guilty to the same charge.

In sentencing, the magistrate said impersonation in examinations was a serious offence, adding that the act of Leung was premeditated and must not be tolerated.

The magistrate also reprimanded Leung for wasting court time in applying for reversal of plea by making serious allegations against the ICAC, but subsequently withdrawing her application.

The magistrate had earlier remarked that the examination system was an important milestone for the academic or employment future of students that must be kept fair, just, clean and creditable.

The case arose from a corruption complaint referred by HKEAA, alleging that an invigilator might have accepted advantages for allowing the impersonation. Subsequent inquiries revealed no evidence of corruption, but the offence of conspiracy to defraud wa s unveiled.

The court heard that in October 2005, Yuen, then a Form 6 student, enrolled as a private candidate in the HKCEE 2006.

In early 2006, Yuen told Leung that she was not confident in passing the mathematics examination in the HKCEE, and requested Leung to impersonate her and sit for the examination. Leung agreed.

On May 8, 2006, Yuen passed to Leung her Hong Kong Identity Card and admission form for the HKCEE.

On the same day, Leung went to the examination centre and took part in both Papers 1 and 2 of the mathematics examination. During the examination, the invigilator did not discover the impersonation.

Admission forms of private candidates did not bear any photo, the court was told.

The prosecution was today represented by Senior Government Counsel Marco Li, assisted by ICAC officer Ming Lee.
