2007-11-12

The managing director of a fast food restaurant chain was today (Monday) charged by the ICAC for allegedly accepting illegal commissions in relation to the supply of corn to the restaurant chain.

Lau Si-sing, 47, managing director of McDonald’s Restaurants (Hong Kong) Limited (McDonald’s), faces two counts of conspiracy for an agent to accept advantages, contrary to Section 9 (1)(b) of the Prevention of Bribery Ordinance and Section 159A of the Crimes Ordinance, and one of conspiracy to pervert the course of public justice.

The defendant will appear in Eastern Magistracy at 9:30 am tomorrow (Tuesday) for mention.

The bribery charges allege that between May 2005 and April 2007, Lau had conspired together with a director of a food company for Lau to accept illegal commissions as rewards for recommending and approving the food company to become the corn supplier of M cDonald’s, placing corn purchase orders with the food company for McDonald’s, and maintaining a business relationship between McDonald’s and the food company.

The alleged illegal commissions were said to be at the rate of 10 per cent of the sales amount of corns supplied by the food company to McDonald’s.

The remaining charge alleges that on June 29, 2007, Lau had conspired together with the food company’s director to pervert the course of public justice by asking the latter to falsely represent to any law enforcement agents that the illegal rebates given by the director to Lau were for the purpose of their joint venture in properties in China.

The management of McDonald’s rendered full cooperation to the ICAC during its investigation.

The defendant has been released on ICAC bail, pending his court appearance tomorrow.
