Police Sergeant arrested and charged for alleged misconduct

The ICAC has arrested and charged a Police Sergeant for alleged misconduct in public office by giving advice to four persons in relation to their suspected unlawful activities.

Edward Fung Hin-wah, 47, Police Sergeant, faces one count of misconduct in public office, contrary to Common Law.

Two of the persons, who have also been charged for their roles in the case, are Lau Kim-hung, 39, decoration worker, and Chu An-bun, 39, unemployed.

Lau and Chu face a joint charge of conspiracy to offer advantages to a public servant, contrary to Section 4(1) of the Prevention of Bribery Ordinance and Section 159A of the Crimes Ordinance.

The first charge alleges that between June 22 and July 5, 2007, Fung, without reasonable excuse or justification, in the course of or in relation to his public office, wilfully misconducted himself by giving advice in relation to unlawful activities to La u, Chu and two other persons.

The second charge alleges Lau and Chu of conspiring together between May 17 and July 9, 2007 to offer Fung advantages consisting of a portion of the shares of a private club proposed to be set up by that two other persons.

The alleged advantages were intended as a reward for Fung offering protection on unlawful activities of Lau, Chu and that two other persons and providing them with prior warning of police impending action.

Meanwhile, Lau and Chu have been charged, in a separate case, for their alleged involvement in drug trafficking activities which were revealed in the course of the ICAC investigation.

Lau and Chu face a joint charge of trafficking in dangerous drugs, while Lau further faces one count of possession of a dangerous drug.

The joint charge alleges that on July 9, 2007, Lau and Chu had unlawfully trafficked in dangerous drugs, namely, 0.22 gramme of ecstasy, 2.32 grammes of ketamine and 0.56 gramme of “ice”.

The other charge alleges Lau of possessing a dangerous drug, namely, 0.36 gram of cannabis in herbal form, on July 9, 2007.

The defendants, currently on ICAC bail, will appear in Kowloon City Magistracy at 9:30 am next Tuesday (April 1) for mention.
