Ex-Dean of HKU’s Faculty of Medicine charged with fraud, misconduct and theft

The former Dean of the Faculty of Medicine of the University of Hong Kong (HKU) was today (Friday) charged by the ICAC with fraud in relation to the billing of private patients of HKU clinical outside practice who received treatment in Queen Mary Hospital . He was also charged with misconduct in public office and theft for allegedly pocketing donations from donors.
Lam Shiu-kum, 65, faces 34 charges –'96 30 counts of fraud, one of misconduct in public office, and three of theft.
The defendant will appear in Eastern Magistracy at 9:30 am next Tuesday (May 27) for mention.
At the time of the above alleged offences, the defendant was the Dean of the Faculty of Medicine of HKU.
The 30 fraud charges allege the defendant of falsely representing to 20 patients between December 2003 and November 2006 that the Gastrointestinal Research (GR), which was wholly owned and controlled by him, was the body to whom medical fees owed by those patients should be paid.
It was alleged that the defendant, with intent to defraud, had induced the patients to make payments, totalling $211,500, to GR, which resulted in benefit to GR or in a substantial risk of prejudice to HKU or the Hospital Authority.
The misconduct charge alleges that between September 2003 and January 2007, the defendant, in the course of or in relation to his public office, without reasonable excuse or justification, had wilfully misconducted himself.
The defendant was said to have failed to declare a conflict of interest arising from his capacity as Dean of Faculty of Medicine of HKU and the GR, and procured or caused donations to be made payable to the bank account of GR which was wholly controlled b y him.
The remaining three theft charges allege that between June 2003 and January 2007, the defendant had stolen a total of $3.8 million, being property belonging to three other patients.
The defendant has been released on ICAC bail, pending his court appearance on Tuesday.
