RTHK officer charged for alleged misconduct over script-writing fees

A Senior Programme Officer of the Radio Television Hong Kong (RTHK) was charged by the ICAC for alleged misconduct in public office in relation to arranging freelance script-writing and research services for the broadcaster.

David Ho Chung-yan, 47, faces one count of misconduct in public office, contrary to Common Law.

He will appear in Kowloon City Magistracy at 9:30 am tomorrow (Tuesday) for mention.

At the time of the alleged offence, the defendant was a Programme Officer of RTHK.

The charge alleges that the defendant, being a public officer, between November 1, 1994 and July 19, 2000, without reasonable excuse or justification, in the course of or in relation to his public office, had wilfully and intentionally culpably misconduct ed himself.

It is alleged that the defendant had arranged or caused to engage his mother to provide freelance services to RTHK, but had allegedly failed to avoid and/or declare to RTHK a conflict of interests arising from his relationship with his mother.

The charge further alleges that the defendant had prepared and processed payment request forms which caused RTHK to make service payments in favour of his mother.

ICAC enquiries revealed that RTHK had effected a total payment of $405,000 to the defendant’s mother based on 93 payment request forms allegedly prepared and processed by the defendant.

The defendant has been released on ICAC bail, pending his court appearance tomorrow.
