Ex-senior engineer charged with fraud over viaduct project

A former senior engineer of a subcontractor in a Highways Department (HyD) project was today (Monday) charged by the ICAC with fraud over the construction of the Castle Peak Road – New Tai Lam Section (the project).
Franky Au Yeung Chi-ho, 32, formerly employed by Alga (Far East) Limited (Alga), will appear in Tuen Mun Magistracy at 9:30 am tomorrow (Tuesday) on one count of conspiracy to defraud and two of fraud.
The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged fraud offences.
Gammon Construction Limited (Gammon) was earlier awarded a contract by HyD for road improvement on Castle Peak Road. The project included the construction of an 800-metre long viaduct connecting Tai Lam Kok and Siu Lam.
Gammon had subcontracted to Alga the tendon stressing work of the project. The defendant was then the project engineer.
The conspiracy charge alleges that between June 2004 and June 2006, the defendant had conspired with a foreman of Alga to defraud Gammon by dishonestly providing false measurements of elongation of stressed tendons during the tendon stressing process.
The other two fraud charges allege the defendant of having provided false measurements of elongation of stressed tendons between June 2005 and August 2006 through two workers of Alga during the tendon stressing process.
As a result of the alleged false measurements, Gammon was caused or induced to accept the measurements as accurate and not to take any actions (including taking any rectification measures) in respect of the said tendons or any structure relating thereto.
HyD had rendered full assistance to the ICAC during its investigation.
The defendant has been released on ICAC bail, pending his court appearance tomorrow.
