Five charged for alleged voting offences at Ho Pui Tsuen VR Election

Five registered voters of the 2007 Village Representative (VR) Election were today (Tuesday) charged by the ICAC in two separate cases for allegedly committing voting offences in the VR election for Ho Pui Tsuen in Yuen Long.

In the first case, the defendants are Fan Shun, 57; Chu Shui-king, 52; Fan Tsz-ning, 27; and Fan Wai-lim, 22, each facing one count of corrupt conduct with respect to voting at an election, contrary to Section 16(1)(a) of the Elections (Corrupt and Illega l Conduct) Ordinance.

The charges allege that on January 6, 2007, the defendants had engaged in corrupt conduct at the 2007 Village Representative Election (Resident Representative) for Ho Pui Tsuen in that they voted at the election knowing that they were not entitled to do s o.

The defendants are alleged to have falsely represented that they had been residents of Ho Pui Tsuen for the three years immediately before registering as electors.

ICAC investigation revealed that the defendants had allegedly moved out from Ho Pui Tsuen since 1997.

In the second case, Fan Yun-sang, 45, faces a similar charge. ICAC enquiries revealed that he had allegedly moved out from Ho Pui Tsuen since 2002.

On the polling day on January 6, 2007, Home Affairs Department staff had reminded electors that if anyone of them had moved out from the village, he or she would be disqualified to vote, and that it would be an offence if the elector voted in the election .

The defendants, currently on ICAC bail, will appear at 9:30 am in Tuen Mun Magistracy on Thursday (October 16) for plea.
