Eleven charged for alleged voting offences at VR elections

The ICAC has charged 11 registered voters of the 2007 Village Representative (VR) Election in nine separate cases for allegedly committing voting offences in the VR elections for Wo Liu Hang in Shatin and Ho Pui Tsuen in Yuen Long.

In the first two cases, the defendants are Christina Lau Yuen-may, 54, Choi Wing-kam, 56, and Lau So-ching, 52, each facing one count of corrupt conduct with respect to voting at an election, contrary to Section 16(1)(a) of the Elections (Corrupt and Ille gal Conduct) Ordinance.

The defendants, currently on ICAC bail, will appear in Shatin Magistracy at 9:30 am tomorrow (Thursday) for plea.

The charges allege that on January 14, 2007, the defendants had engaged in corrupt conduct at the 2007 VR Election (Resident Representative) for Wo Liu Hang in that they voted at the election knowing that they were not entitled to do so.

It is alleged that the defendants were not residing at Wo Liu Hang in the past three years before registration as electors or at the time they voted at the election.

It is alleged that Lau Yuen-may and Choi Wing-kam had moved out from Wo Liu Hang since 2006, and that Lau So-ching had not been a resident of Wo Liu Hang since 1978.

In six other cases, Lam Nim-kiu, 46; Lau So-chun, 57; Tam Lau Sau-kwan, 55; Lau Wan-sze, 31; Lai Man-chun, 45; and Lau Wai-kwong, 54, each faces a similar offence in relation to the VR election for Wo Liu Hang.

It is alleged that the defendants were not residing at Wo Liu Hang in the past three years before registration as electors or at the time they voted at the election.

The defendants, who have been released on ICAC bail, will appear in Shatin Magistracy at 9:30 am on Friday (October 24) for plea.

In the last case, Fan Yuet-lun, 56, and his wife Lai Tai-mui, 53, have each been charged with a similar offence in relation to the VR election on January 6, 2007 for Ho Pui Tsuen in Yuen Long, following the prosecution of five others last week.

Fan and Lai are alleged to have moved out from Ho Pui Tsuen since 1991.

On the respective polling days of the VR elections for Wo Liu Hang and Ho Pui Tsuen, Home Affairs Department staff had reminded electors that if anyone of them had moved out from the village, he or she would be disqualified to vote, and that it would be a n offence if the elector voted in the election.

The defendants, currently on ICAC bail, will appear in Tuen Mun Magistracy at 9:30 am tomorrow (Thursday) for plea.
