Ex-managers of paper merchant’s subsidiary jailed for accepting $900,000 bribes

Two former managers of a subsidiary of a paper merchant, charged by the ICAC, were today (Monday) each sentenced to 22 months’ imprisonment at the District Court for accepting $900,000 in bribes for awarding transportation orders to a transportation company.

Chan Fuk-shing, 44, former logistics manager of Tech Solutions Limited (TSL), and Chu Wai-ching, 37, former transportation manager of TSL, were also each ordered to pay a restitution of $450,000 to their former employer.

In sentencing, Judge Andrew Chan Hing-wai said custodial sentences were appropriate for the defendants as their bribery offences, lasting a long period of time, were serious and constituted a breach of trust.

Chan and Chu faced six joint charges of agents accepting advantages, contrary to Section 9(1)(b) of the Prevention of Bribery Ordinance.

Chan earlier pleaded guilty to all six charges, while Chu admitted five of them. The remaining charge against Chu was ordered to be left on court file.

The court heard that TSL was a subsidiary of Che San & Company Limited (Che San), a paper merchant in Hong Kong, to perform transportation works.

In early 2001, Chan entered into an agreement with the proprietor of Lau Wing (Kai Win) Transportation (Lau Wing).

According to the agreement, Chan would arrange for transportation works to be awarded to Lau Wing by Che San and later by TSL when it was formed.

The proprietor of Lau Wing agreed to pay a monthly bribe payment to Chan and Chu as rewards for placing transportation orders with Lau Wing.

Between April 2002 and July 2007, Chan and Chu accepted a total of $900,000 from the proprietor of Lau Wing, the court was told.

The prosecution was today represented by Senior Public Prosecutor Beney Wong, assisted by ICAC officer Yvonne Yip.
