Insurance agent jailed for using false documents to deceive HK$7m

An insurance agent, charged by the ICAC, was today (Wednesday) sentenced to 34 months’ imprisonment at the District Court for using false documents to transfer two insurance policies to herself and swindle about HK$7.4 million in funds.

Mok Sum, 40, today pleaded guilty to two counts of using false instruments, and nine of dealing with property known or reasonably believed to represent proceeds of an indictable offence under Section 25 of the Organised and Serious Crimes Ordinance.

In passing sentence, Judge Susana D’Almada Remedios said a custodial sentence had to be imposed on the defendant in view of her premeditated plan to deceive a substantial sum of money from the victim.

The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above offences.

The court heard that at the time of the offences, the defendant was an insurance agent of Manulife (International) Limited (Manulife).

In early 2006, the defendant came to know a Mainland businessman through a friend, and they soon became lovers.

Under the defendant’s arrangement, the businessman took out two investment-linked insurance policies with Manulife in April and May 2006, in the respective amount of HK$1.8 million and US$500,000.

In November 2006 and January 2007, the defendant forged the signature of the businessman on two forms respectively to change his correspondence address in the two policies to her own residential address.

The defendant further forged the businessman’s signature on two transfer forms, on which she claimed herself as the businessman’s wife with her daughter as the beneficiary, so as to transfer the two policies to herself. The transfers were subsequently approved by Manulife.

The court heard that between April and December 2007, the defendant had redeemed a total of about HK$7.4 million from the two policies on nine occasions.

The said sums of money were deposited into the defendant’s personal bank accounts, the court was told.

The prosecution was today represented by Public Prosecutor Sheroy Tam, assisted by ICAC officer Lai Yiu-wai.
