Medical and Health Officer charged with misconduct

A Medical and Health Officer has been charged by the ICAC for alleged misconduct by making bogus medical consultations and appointments.

Michael Ho Hung-kwan, 43, faces two counts of misconduct in public office, and nine alternative charges –'96 three of fraud and six of access to computer with criminal or dishonest intent.

The defendant will appear in Kowloon City Magistracy at 9:30 am on Friday (August 6) for plea.

The case arose from a corruption complaint referred by the Hospital Authority (HA). Subsequent ICAC enquiries revealed the above alleged offences.

At the time of the above alleged offences, the defendant was attached to the Central Kowloon Health Centre (CKHC), a general out-patient clinic managed by the HA.

One of the misconduct charges alleges that the defendant falsified records in the computer system of the HA, purporting to show that his family members had on various occasions attended the CKHC for medical consultations provided by him when they had not in fact so attended; and caused the HA to issue prescribed medicines to his family members concerned.

Three other alternative charges allege that the defendant, with intent to defraud, induced the HA to issue prescribed medicines to his family members concerned by falsely representing that they had on various occasions attended the CKHC for medical consul tations.

Another misconduct charge alleges that the defendant used the personal particulars of patients of the HA, without their prior knowledge and approval, to make bogus bookings of medical appointments, and caused the medical appointments to be either cancelle d shortly before the time of the appointments or defaulted.

The remaining six alternative charges allege the defendant of having obtained access to a computer operated by the HA by making entries in respect of six patients with a dishonest intent to deceive.

The above alleged offences took place between June 2007 and December 2008.

The HA has rendered full assistance to the ICAC during its investigation.

The defendant has been released on ICAC bail, pending his court appearance on Friday.
