Policeman faces court for alleged misconduct and forgery

A Senior Police Constable today (Wednesday) appeared at Eastern Magistracy after being charged by the ICAC for alleged misconduct and forgery in relation to a police investigation into a theft case.

Lam Chi-yung, 42, faced one count of misconduct in public office, contrary to the Common Law, and one count of forgery.

No plea was taken. Acting Principal Magistrate Amanda Jane Woodcock transferred the case to the District Court for plea on November 30.

At the time of the above alleged offences, the defendant was the investigating officer of a theft case, in which a woman was suspected to have committed shoplifting at a department store in Hunghom.

The misconduct charge alleged that between February 2 and 21 this year, the defendant made an unauthorised private visit to the woman suspect at her residence, incited her to plead guilty to a subsequent charge of theft in order to reduce his own workload , and failed to make any record in respect of the visit.

The defendant was also alleged to have falsified entries in his police notebook and investigation report purporting to show that a statement was taken by him from a key witness in the theft case on February 4 this year.

The forgery charge alleged that the defendant had falsified the date of the statement from February 2 to February 4 this year, with the intention of inducing his supervisor to accept it as genuine, and by reason of so accepting it to do or not to do some act to the supervisor’s prejudice.

The defendant was granted cash bail of $2,000, and ordered not to interfere with prosecution witnesses.

The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged offences.

The Police had rendered full assistance to the ICAC in its investigation.
