Ex-shipping supervisor jailed for accepting $219,000 illegal commissions

A former shipping supervisor of a logistics company, charged by the ICAC, was today (Friday) sentenced to 10 months’ imprisonment at the District Court for accepting over $219,000 in illegal commissions for placing orders with three transportation companies.

Chan Mung-na, 39, formerly employed by Kind Nice Limited (Kind Nice), was also ordered to pay a restitution of over $219,000 to her former employer.

The defendant was earlier found guilty of one count of agent accepting an advantage, contrary to Section 9(1)(a) of the Prevention of Bribery Ordinance.

In sentencing, Deputy Judge Anthony Yuen Wai-ming said in view of the seriousness of the bribery offence, a custodial sentence had to be imposed on the defendant to serve as a deterrent.

The court heard that while employed by Kind Nice, the defendant was responsible for awarding transportation orders to various contractors. Under her supervision was Wong So-chun, a shipping clerk.

In June 2002, the defendant and Wong had a meeting with an operator of three transportation companies, during which the operator initiated to offer to the defendant and Wong commissions as rewards for awarding transportation orders to her.

After consideration, the defendant and Wong acceded to the operator’s offer, and used their own bank accounts to receive illegal commissions from her.

The court heard that between June 2002 and December 2005, Kind Nice awarded transportation orders worth over $7.9 million to the operator.

In return, the defendant and Wong accepted illegal commissions totalling more than $219,000 and over $31,000 from the operator respectively.

The management of Kind Nice prohibited its employees from soliciting or accepting advantages in relation to the company’s business, the court was told.

Wong, 37, who was also charged by the ICAC, was earlier convicted at Kowloon City Magistracy of one count of aiding, abetting, counselling or procuring an agent to accept an advantage.

She was subsequently jailed for nine months, and ordered to pay a restitution of over $31,000 to Kind Nice.

The prosecution was today represented by Senior Public Prosecutor June Cheung, assisted by ICAC officer Sarah Wong.
