Police Sergeant charged with misconduct over suspected drug trafficking case

A Police Sergeant has been charged by the ICAC with misconduct in public office in relation to the handling of a suspected drug trafficking case.
Leung Wai-yin, 46, faces one count of misconduct in public office, contrary to the Common Law.
The defendant will appear at Tuen Mun Magistracy at 9:30 am tomorrow (Thursday) for transfer to the District Court for plea.
At the time of the alleged offence, the defendant was attached to a team of the District Anti-triad Section (DATS) of Yuen Long Police District.
The charge alleges that between September 3, 2008 and March 31, 2009, the defendant, without reasonable excuse or justification, in the course of or in relation to his public office, wilfully misconducted himself.
The defendant was alleged to have initiated and proposed to a man and his wife that they engage a barrister-at-law to act for their son in a suspected drug trafficking case, in which the latter had been arrested and charged by the DATS team and that the d efendant was a member of the said police team and had personal knowledge of the investigation.
The defendant was also alleged to have represented to the couple that the barrister-at-law was in a position to influence the officer in charge of the police team, and that the officer-in-charge would show favour to the defence in handling the case.
It was alleged that the defendant also arranged and participated in a dinner gathering with the couple, the barrister-at-law and a legal executive of a solicitors firm, and discussed with them the suspected drug trafficking case.
The defendant was also alleged to have solicited from the man a loan of $5,000 in the course of discussing the suspected drug trafficking case.
The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged offence.
The Police have rendered full assistance to the ICAC during its investigation.
The defendant has been released on ICAC bail, pending his court appearance tomorrow.
