One more arrested and charged with vote-rigging in DC Election

A man has been arrested and charged today (Monday) by the ICAC for alleged vote-rigging in the King’s Park Constituency of the Yau Tsim Mong District in the 2011 District Council (DC) Election following the prosecution of six other persons.
Wong Ka-hong, 29, hawker, faces one count of engaging in corrupt conduct with respect to voting at an election, contrary to Section 16(1)(b)(i) of the Elections (Corrupt and Illegal Conduct) Ordinance (ECICO).
The defendant will be brought to Kowloon City Magistracy for mention at 9:30 am tomorrow (Tuesday).
The charge alleges that on November 6, 2011, the defendant engaged in corrupt conduct at the 2011 Yau Tsim Mong DC Election (King’s Park Constituency) by voting at the election after having given false information to an Electoral Officer that a flat of a building in Yin Chong Street, Mongkok, as recorded in the final register, was his present residential address.
Six other persons, who were earlier arrested and charged by the ICAC for allegedly engaging in corrupt conduct in connection with the 2011 DC Election, appeared at Kowloon City Magistracy today (Monday).
The defendants were James Ho Chun-fai, 45, movie projectionist; Meicy Chan Mei-sze, 38, manager; Lau Ching-ki, 39, self-employed; Wong Ka-kin, 34, chef; Kumiko Lee Hoi-ki, 21, receptionist; and Fung Ka-lun, 34, electrician.
The defendants each faced one count of engaging in corrupt conduct with respect to voting at an election, contrary to Section 16(1)(b)(i) of the ECICO.
No pleas were taken today. Acting Principal Magistrate Ms Bina Chainrai adjourned the case to February 8, 2012 for mention, pending further enquiries and legal advice.

The defendants were granted cash bail ranging from $10,000 to $20,000. They were also ordered to surrender their travel documents to court, not to leave Hong Kong, not to interfere with prosecution witnesses, to reside at their reported addresses, and in form the ICAC 24 hours prior to any change of residence.
An ICAC spokesman stressed that the Commission, in enforcing the ECICO, had a statutory duty to investigate suspected vote-rigging cases whereby registered electors voted at an election after having given materially false or misleading information to Elec toral Officers.
The prosecution was today represented by Senior Assistant Director of Public Prosecutions Polly Wan, assisted by ICAC officer Vivian Lee.
