Eight charged with false registration of electors in DC Election

Eight persons have been charged by the ICAC today (Thursday) with providing false information in the registration of electors in the King’s Park Constituency of the Yau Tsim Mong District in the 2011 District Council (DC) Election.

The defendants each face one charge of knowingly making a false statement in voter registration and an alternative charge of recklessly making an incorrect statement in voter registration, contrary to Section 22(1)(a) of the Electoral Affairs Commission ( Registration of Electors) (Legislative Council Geographical Constituencies) (District Council Constituencies) Regulation.

The eight defendants will appear in Kowloon City Magistracy at 9:30 am tomorrow (January 13) for mention in four separate cases.

The cases arose from complaints alleging voting offences under the Elections (Corrupt and Illegal Conduct) Ordinance in relation to the DC Election. Subsequent ICAC enquiries revealed the above alleged offences as they did not cast their votes in the DC Election.

In the first case, the defendants are Cheung Yu-hon, 21, student; Lui Sze-kwok, 41, proprietor; Lao Cheng-nga, 34, housewife; and Ching Tak-ho, 30, salesman.

The charges allege that on July 16, 2011, Cheung, Lui, Lao and Ching, in their applications made under Section 4 of the Regulation for them to be registered in a provisional register, knowingly or recklessly made a false or incorrect statement that a flat in Foo Tat Building, 50 Soy Street, Mongkok, was their residential address.

In the second case, Lee Ho-yin, 27, financial consultant, is alleged to have knowingly or recklessly made a false or incorrect statement that another flat in Foo Tat Building, 50 Soy Street, Mongkok was his residential address.

In the third case, Tang King-yee, 59, hawker, and Li Kin-yuen, 53, unemployed, are alleged to have knowingly or recklessly made a false or incorrect statement that a flat in Hung Kwong Building, 2A-2P Tung Choi Street, Mongkok was their residential addres s.

In the last case, Kong Shui-tin, 51, hawker, is alleged to have knowingly or recklessly made a false or incorrect statement that a flat in Hung Fai Building, 2Q-2Z Tung Choi Street, Mongkok was his residential address.

The Registration and Electoral Office had rendered full assistance to the ICAC during the investigation.

The defendants have been released on ICAC bail, pending their court appearance tomorrow.
