Ex-councillor charged with $136,000 false claims

A former member of the Tuen Mun District Council (DC) has been charged by the ICAC today (Wednesday) for her alleged false claims of Operating Expenses Allowances (OEAs) totalling $136,000 from the Tuen Mun DC.
Cheung Yuet-lan, 55, faces a total of three charges –'96 two of fraud and one of conspiracy to defraud.
The defendant, currently on ICAC bail, will appear in Tuen Mun Magistracy at 9:30 am tomorrow (Thursday) for plea.
The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged fraudulent claims.
At all material times, the defendant was an elected member of Yau Oi South Constituency of the Tuen Mun DC.
Two of the charges allege that between May 30 and June 6, 2008, the defendant falsely represented that she had paid Lam Lap salaries totalling $40,000. Lam was an unpaid volunteer of the defendant’s ward office.
It was alleged that with intent to defraud, the defendant induced the Tuen Mun DC Secretariat to arrange to pay the $40,000 as OEAs to her, resulting in benefit to her or in prejudice to the government.
The remaining charge alleges the defendant of conspiring with Lam on a day after September in 2008 to defraud the Tuen Mun DC Secretariat.
The defendant was alleged to have dishonestly asked Lam to sign 12 salary receipts; falsely represented to the secretariat that Lam was employed and paid by her for 12 months at a monthly salary of $8,000; and caused the secretariat to arrange to pay mone y to her as reimbursement for the said salaries.
Lam, 73, retired, who was earlier charged by the ICAC, pleaded guilty to two counts of conspiracy to defraud at Tuen Mun Magistracy. He will also appear in the magistracy tomorrow for mention.
